Strive Challenge 2016 – Participant Terms And Conditions

1.  STRIVE

1.1  The Virgin STRIVE Challenge 2016 is a multi-discipline, ultra endurance fundraiser event that will see a core team of individuals (the “Core Team”) endeavour to hike from Zermatt, Switzerland to Rima St Guiseppe, northern Italy, then cycle in three Stages (as defined below) to Villa San Giovanni, then complete a triathlon consisting of a swim across the Strait of Messina to Sicily, and a mountain bike and trail run sections ending on Mount Etna. (“STRIVE” or the “Event”).

1.2  Up to 340 individual participants (individually “Participant”) can apply to join the Core Team on the hike, cycle and/or triathlon legs (each a “Stage”) of the Event .

1.3  The Event is owned by Big Change Trading Limited of Hanover House, 14 Hanover Square, London, W1S 1HP (the “Company” or “Big Change”) and organised logistically by Threshold Sports Limited (the “Event Organiser”) and, Dream Guides Ltd (the “Trek Supplier”) and subject to clause 1.4 is scheduled to take place between 1st September and 30th September 2016.

1.4  Whilst Big Change does not intend to make significant changes, Big Change reserves the right to change the time, date, route, rules, regulations or format of the Event and to cancel the Event, in whole or in part, without liability to any party. Big Change will give Participants notice of any such changes as soon as reasonably possible.

 

2.  Participants, Entry and Entry Fee

2.1  Participants must be aged 18 or over to enter.

2.2  Participants must be available to travel to and attend the Stage(s) entered on the date(s) set out in Table 1 (or such other date(s) as Big Change shall notify in accordance with clause 1.4). Participants who cannot travel on these days are responsible for making their own arrangements, at their own cost. Participants must contact the Event Organiser (on such contact details that will be notified to them) who will give instructions for the meet point and time of registration.

2.3 To enter, visit the STRIVE website located at http://bigchange.strivechallenge.com/registration/, complete and submit the registration form along with payment of the applicable entry fee as set out in Table 1(“Entry Fee”). Note that your place will only be confirmed once the Entry Fee has been received by Strive and you have received a confirmation email.

2.4  The Entry Fee is non-refundable and non-transferable (except as set out in clause 5.2 below).

2.5  Entry to each Stage will close on the earlier of 1st July 2016 or once the Participant places for that Stage have been filled

3.      Sponsorship

3.1.    By taking part in the Event, Participants agree to set up a fundraising donations page on Virgin Money Giving located at: https://uk.virginmoneygiving.com/giving/ and use reasonable endeavours to raise the following amounts for each Stage participated in in sponsorship donations (“Sponsorship Donations”) for Big Change Charitable Trust (registered charity number 1145224):

 

4.  Event Rules

4.1  Big Change requires all Core Team participants to provide () an authorised Certificate of Competitive Fitness and ECG report from a duly authorised medical practitioner that is valid for one year from issue by 1st July 2016 and (ii) a duly signed release of liability (to be provided to each Participant prior to the Event) (the “Release of Liability”).. Big Change reserves the right to request that a medical certificate be produced by Participants before he/she is able to participate in the Event to confirm that the Participant is fit and able to participate in the Event.

4.2  Big Change, the Event Organiser and the Trek Supplier reserve the right to remove any Participant from the Event at any time (at Big Change’s, the Event Organiser’s or the Trek Supplier’s discretion) including, without limitation, for breach of these terms and conditions or due to ill health of the Participant that may render him/her unfit to safely complete the Event.

4.3  No illegal substances are permitted to be used by any Participant either before or during participation in the Event. Big Change, the Event Organiser and the Trek Supplier reserve the right to refuse attendance at, or participation in, the Event by any persons found to have consumed or to have in their possession any illegal substances of any kind.

4.4  Big Change shall use reasonable endeavours to provide the Participant with certain items of event kit (see Table 1). Where Big Change is unable to provide all relevant pieces of kit for the Event Big Change shall provide each Participant with a list of kit that the Participant is required to source themselves at least one month before the Event. It is each Participant’s responsibility to ensure that they have all kit necessary to participate in the Event.

4.5  As a continuing condition of entry each Participant shall ensure that, for the duration of the Event:

4.5.1  he/she follows the Event route as signed/instructed at all times, and does not deviate from the official Event route

4.5.2  he/she will provide their own safety approved cycle helmet which is to be worn at all times when cycling;

4.5.3 his/her road bike is in good condition and is appropriate and roadworthy for the cycle Stages of the Event. Big Change cannot guarantee a replacement road bike for the Participant to use should his/her own bike suffer mechanical failure;

4.5.4 he/she acknowledges the recommended kit list of the Event, in accordance with the Event Stage, and is responsible for bringing appropriate clothing and equipment to participate in the Event;

4.5.5 he/she participates responsibly and safely and abides by all Event rules and regulations notified by Big Change, the Event Organiser or the Trek Supplier;

4.5.6  where applicable, he/she shall hold valid and proper legal identification documents (e.g. passport including visa (where necessary)) required for travel within Europe;

4.5.7 he/she holds suitable personal and travel insurance which covers, amongst other things, loss or damage to your bike and personal belongings, helicopter rescue, and treatment and repatriation costs in the event of injury/medical emergency (and will produce evidence of the same to Big Change upon request).

 

5.  Withdrawals, Cancellations and Transfers

5.1  Big Change shall not be liable for any loss, damage or expense caused by cancellation, curtailment or change of schedule of the Event due to, without limitation, government action, war, strike, royal death, civil commotion, terrorism, national disaster, or other force majeure or cause beyond the reasonable control of Big Change.

5.2  If the Participant wishes to withdraw from the Event, he/she is allowed to transfer their place to another individual with the consent of Big Change. To transfer his/her place to another individual, Big Change must receive a written request by 17:00 GMT on 1st July 2016 and the new Participant must agree to comply with all of the terms and conditions set out herein. Big Change reserves the right to refuse any such transfer at its discretion.

 

6.  Participant’s Warranties and Undertakings

6.1  The Participant agrees to be bound by these terms and conditions and all other Event rules and regulations notified to him/her by Big Change, the Event Organiser or the Trek Supplier, Participants acknowledge and agree that Big Change, the Event Organiser and the Trek Supplier will organise and run the Event and will have authority and be the final arbiters on all decisions relating to the all aspects of the Event, including health and safety, logistical operations, and participation.

6.2  The Participant agrees at all times during the Event to abide by the reasonable instructions and guidelines of Big Change’s staff, nominated representatives, and contractors and those of the Event Organiser and the Trek Supplier and to behave appropriately at all times on the route and in the base camps.

6.3  The Participant understand that is they contravene the decisions or advice of Big Change’s staff, nominated representatives, and contractors and those of the Event Organiser and the Trek Supplier or undertake independent activities during the Event, it will terminate all protection and duty of care from those parties.

6.4  The Participant confirms that he/she will not take part in the Event if he/she is suffering from any contagious illness and confirms that he/she will report any illness during the Event to the Event medical team immediately.

6.5 The participant confirms that in the event of an accident or illness during the Event, he/she gives permission for the Event Organiser, the Trek Supplier or their nominated qualified medical team representatives to initiate medical treatment. They also authorise them to inform his/hers next of kin in case of hospitalisation, as well as be provided with key medical information on their condition from hospital staff.

6.6  The Participant confirms that he/she understands that the Event involves substantial and sustained physical exercise in remote areas and open roads and trails.

6.7  The Participate agrees that he/she is responsible for their own fitness to take part in the Event, and will consult a doctor prior to the Event if necessary.

6.8  The Participant confirms that, to the best of their knowledge, he/she has given a true and accurate description of their medical history and current condition. He/she understands that they are responsible for informing Big Change of any change in medical condition, including pregnancy, which may arise between now and the Event date, and also during the Event.

6.9  The Participant confirms that he/she will not publish or post on any website or other media (including fundraising webpage) any text, statement, photograph, image or other material which relates to the Event and/or sponsors of the Event which is obscene, blasphemous, defamatory, infringes the intellectual property or other legal rights of any third party or is otherwise unlawful, offensive or inappropriate.

6.10  The participant agrees not take, record and/or transmit any sound, image and/or description of the Event other than for private and domestic use unless with prior agreement from Big Change.

 

7.  Participant Image Release

Big Change reserves the non-exclusive right and license throughout the world (and Participant hereby grants Big Change such non-exclusive right and license at no cost) to interview and/or photograph and/or film the Participant at the Event (and before and after the Event as Big Change may reasonably require) and to the unlimited, worldwide, sub-licensable right (at no cost) to record, film, reproduce and use in all current and future media (including without limitation, print, audio, visual, audio-visual, virtual media, the internet, mobile telephony and so-called “3-G” technologies, CD-ROM or DVDs) the Participant’s name, likeness and image or facsimile image, signature, voice, video and film portrayals and other means of identification of the Participant, and any biographical or other information or data related to the Participant (including ride times and results), in connection with the production, advertisement, marketing, promotion or sale of Event sponsor products and/or the promotion, marketing or advertisement of the Event, Big Change or any Event sponsor.P

 

8. Privacy Statement

8.1  The Participant agrees and consents to Big Change using his/her personal details provided for the following purposes:

8.1.1  Event administration

8.1.1.1 As the Event organiser, Big Change requires a record of your registration details including third party emergency contact details for internal administration purposes in order to properly conduct and to safely administer the Event

8.1.1.2  Big Change will also keep records of medical information provided that it is kept confidential and may be shared only with medical personnel or teams allocated to the Event. Such information shall be deleted within a reasonable time following the completion of the Event unless you agree that we may use such information for future BCCT events, which are staged within a reasonable timeframe thereafter.

8.1.2 E-mail/SMS communications

8.1.2.1  Big Change will use the Participant’s contact data submitted on the registration form to send the Participant information by e-mail and/or SMS relating to the Event, other Big Change events and any further categories of news and promotional information as the Participant may have requested on the registration form.

8.1.2.2  The Participant acknowledges and agrees that Big Change may send an e-mail or SMS notification following the Event inviting the Participant to submit or renew his/her registration for any future Big Change

8.2  All information relating to Participants collected by or on behalf of Big Change from which each Participant can be identified will be recorded electronically and will be used at all times in accordance with the Data Protection Act 1998. Big Change will not disclose any such information to third parties, save as expressly stated under these terms and conditions. Each Participant is entitled to withdraw his/her consent to categories of e-mail and/or SMS communications from Big Change and can do so at any time by following the opt-out instructions provided in the relevant e-mail. Participants acknowledge that a valid e-mail address or SMS contact number will be required at all times in order for Participants to receive important Event information and the Participant hereby consents to receive any such information.

8.3  To delete all of their information from Big Change’s database, Participants may email us directly at info@big-change.org In circumstances where the Participant requests deletion of his/her Participant’s profile, Big Change reserves the right to maintain information about individual sales transactions (not including credit card details) and any documentation relating to medical treatment required during the Event for record keeping. The Participant’s attention is also drawn to clause 8.4 below.

8.4  Subject to the Participant’s right to modify or request the deletion of data from Big Change’s database, the Participant hereby acknowledges that it is a strict condition of participation in the Event that all mandatory fields within a Participant’s profile are complete and correct at all times. These fields include, without limitation, gender, first name, surname, date of birth, passport number and expiry date, medical condition information and emergency contact details. The Participant hereby acknowledges and agrees that this information is required by Big Change in order to properly and safely administer and conduct the Event, and Big Change reserves the right to refuse an applicant or a Participant entry to the Event in circumstances where that person either requests the deletion of such mandatory information from their Participant’s profile, or provides false or incomplete information.

 

9  Governing Law

9.1  These terms and conditions constitute a legally binding contract between the Participant and Big Change and, together with the Release of Liability, constitutes the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event.

9.2  If there is an inconsistency between any of the provisions of these terms and conditions and the provisions of the Release of Liability, the provisions of the Release of Liability shall prevail.

9.3  If any provision in these terms and conditions (in full or in part) is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable

These terms and conditions shall be interpreted in accordance with the laws of England and Wales and any dispute arising hereunder shall be subject to the exclusive jurisdiction of the English courts.
